These Terms of Service ("Terms") govern your access to and use of HomebuyerHeadStart.com (the "Site") and any forms, content, videos, or services made available on or through the Site (collectively, the "Services").
Homebuyer Head Start is an educational program associated with the Krevoy Team. Krevoy Team Marketing Inc. manages website marketing, CRM, and communications for the Homebuyer Head Start program.
Mortgage loan origination services referenced on the Site are provided by California-licensed Mortgage Loan Originators Barry Krevoy (NMLS #923896) and Shane Krevoy (NMLS #1295481) through The Turnkey Foundation, Inc. dba Arbor Financial Group (NMLS #236669), the sponsoring California-licensed mortgage broker. Arbor Financial Group is an Equal Housing Lender.
By accessing the Site or submitting any form, you agree to these Terms. If you do not agree, do not use the Site.
The Site provides educational content about home buying, mortgages, and pre-qualification. Forms on the Site, including the Short Pre-Qualification Check and the Detailed Buyer Readiness Check, are pre-qualification and educational tools only. They are not:
A full mortgage application is a separate process handled through the sponsoring broker, Arbor Financial Group, under applicable California licensing rules, and requires your separate written authorization.
Nothing on the Site constitutes legal, tax, financial planning, accounting, or real estate advice. You should consult qualified professionals before making decisions about a home purchase, mortgage, or any related financial matter.
Use of the Site does not create a fiduciary, advisor, or attorney-client relationship between you and the Krevoy Team, its MLOs, Krevoy Team Marketing Inc., or Arbor Financial Group. A formal mortgage origination relationship is established only when you sign the required disclosures and a loan application is taken under Arbor Financial Group's licensed brokerage.
You must be at least 18 years old and a resident of the United States to use the Services. By using the Services, you represent and warrant that you meet these requirements.
When you submit information through any form on the Site, you agree that the information you provide is truthful, accurate, and complete to the best of your knowledge.
Providing false or misleading information to a mortgage originator can have legal consequences and may disqualify you from loan programs.
Your information is handled according to our Privacy Policy, which is incorporated into these Terms by reference.
Program description. Krevoy Team Marketing Inc. manages SMS communications for the Homebuyer Head Start program. When you provide your mobile phone number through the Site, you may separately and voluntarily consent to receive marketing and/or non-marketing SMS messages. Non-marketing messages. If you separately consent to non-marketing SMS messages, you may receive messages from Krevoy Team Marketing Inc. regarding Homebuyer Head Start inquiries, requested educational information, appointment confirmations and reminders, program updates, and related follow-up.
Educational scope. The SMS program is for Homebuyer Head Start educational communications. SMS messages sent under this program do not advertise, offer, arrange, or originate mortgage loans or other financial products.
Consent. Marketing and non-marketing SMS consent options are presented separately. SMS consent is optional, is not a condition of submitting a form or obtaining services, and consent options are not selected by default.
Message frequency. Message frequency varies based on your interaction with us.
Cost. Message and data rates may apply.
Opt-out. You can cancel SMS messages at any time by replying STOP to the number that messaged you. After you text STOP, you may receive a confirmation message and no further messages covered by that opt-in will be sent unless you subsequently opt in again.
Help. For help, reply HELP to any message or contact us at [email protected].
Carrier liability. Wireless carriers are not liable for delayed or undelivered messages.
Eligibility. You must be 18 or older to opt in to text messages.
Privacy. Mobile information and SMS/text-messaging opt-in data and consent will not be shared, sold, or rented to third parties or affiliates for their marketing purposes. For additional information about how we collect and use personal information, see our Privacy Policy.
All content on the Site, including text, video, graphics, logos, course materials, and the design of the Site itself, is owned by Krevoy Team Marketing Inc., its MLOs, or our licensors, which may include Arbor Financial Group where applicable, and is protected by U.S. and international intellectual property laws.
You are granted a limited, revocable, non-transferable, non-exclusive license to access and view the Site and Services for your personal, non-commercial homebuyer education.
You may not:
The "Krevoy Team," "Homebuyer Head Start," "Arbor Financial," "4IR Inc," and "AIVA" names and logos are trademarks of their respective owners.
The Site may link to third-party websites, tools, or services, for example calculators, lender directories, or mortgage rate tracking sites. We do not control those third parties and are not responsible for their content, products, services, privacy practices, or accuracy.
Your use of any third-party site is subject to that third party's terms and policies.
You agree not to:
We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms.
The Site and Services are provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, the Krevoy Team, its MLOs, Krevoy Team Marketing Inc., and Arbor Financial Group disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, or error-free, or that any content is accurate or complete.
Mortgage rates, programs, and guidelines change frequently. Any information about loan products, rates, or programs on the Site is for general illustration only and is subject to change without notice. Final terms depend on a full application and underwriting review.
To the maximum extent permitted by law, the Krevoy Team, its MLOs, Krevoy Team Marketing Inc., Arbor Financial Group, and their respective owners, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, or business interruption, arising out of or related to your use of the Site or Services, even if advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to the Site or Services will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless the Krevoy Team, its MLOs, Krevoy Team Marketing Inc., Arbor Financial Group, and their respective owners, officers, employees, contractors, and affiliates from any claim, demand, loss, or expense, including reasonable attorney fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction in those courts.
To the extent permitted by applicable law and not inconsistent with mandatory federal mortgage-lending dispute-resolution rules, any dispute arising out of or related to these Terms or the Site that cannot be resolved through good-faith negotiation will be resolved by binding individual arbitration under the rules of the American Arbitration Association, and not as a class, collective, or representative action.
This Section 13 does not limit your right to file an individual complaint with any state or federal regulator, including the Consumer Financial Protection Bureau.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be highlighted on the Site or sent to you by email when appropriate. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement regarding the Site and Services.
